GlassesOnline SL presents below the General Contracting Conditions that will regulate the information provided by the online store www.gafasonline.es (hereinafter, the Web), as well as the commercial transactions between it and its users.

These conditions will be understood as accepted by the users who browse the Web and purchase the products offered therein. However, the owner of the page may, without prior notice, modify these conditions when deemed necessary for its proper functioning.

That said, the following are established as GENERAL CONTRACTING CONDITIONS:

2.2 SHIPPING COSTS

3.- PAYMENT AND DELIVERY METHODS

3.1 OUR PRICES

The price of our products is the one that appears on the Web including VAT.

 

3.2 PAYMENT METHODS

The means of payment that we accept are the following Paypal, bank transfer, cash deposit, credit / debit card, cash on delivery and store payment.


a) CREDIT OR DEBIT CARD: Secure payment with T.P.V. Virtual. Being the accepted cards: Visa, Mastecard, 4B. This form of payment does NOT accept American Express card payments.

b) PAYPAL: You can make a deposit from your paypal account to our paypal account which is the following: pagospaypal@gafasonline.es

Orders paid through the paypal gateway must be verified. This order will have to be made by the owner of the paypal account and notify paypal to whom and where they want the delivery to be made. The address that appears in the paypal account (Rules established by paypal) will prevail for shipping. In case of conflict in the shipment we would contact the owner of the Paypal account.

Payments by credit / debit card and PayPal do not entail any expense for the buyer. Gafasonline reserves the right to request the appropriate documentation (photocopy of the ID, passport or credit card) in the event that the identity of the buyer is not credibly proven and request another method of payment.

c) CASH ON DELIVERY: The amount of the order will be paid upon delivery in cash with an additional cost of € 7.50 for management expenses.


In the case of customized products, replacement lenses or accessories, this form of payment will not be accepted.

 

d) BANK TRANSFER OR CASH INCOME

  You must do it in the account of the Santander  Nº ES21 0049 6024 44 2316088751 indicating your order number (Account holder GafasOnline S.L CIF B-98569551).

For international transactions the bank details are the following:

Any cost of the bank transfer will be borne by the client.

e) PAYMENT IN STORE

You can choose this option as long as you choose in STORE PICKUP shipping methods.

This form of payment has an increase of € 3.50 on the web order.

f) BIZUM

Make your payment through your mobile phone and your Bizum password. For this you will need to be registered in the Bizum service and that your bank is attached to payments for online commerce. You can check which ones are already attached here. The Bizum key you need can be obtained through your bank's APP. You only have to select payment by bizum in the purchase process and finalize your order. It will ask for your phone number and your Bizum password. Afterwards, you will only have to validate the payment with the code sent by your bank.

 

INFORMATION NOTE: This company does not work with TAX FREE.


Finally, Gafasonline.es reserves the right to reject all orders or deliveries if the banking organizations reject the authorization of payment of the credit / debit card; or in case the payment is not made in whole or in part. What's more. Gafasonline.es will not be responsible in any case for fraudulent purchases made by third parties with the stolen data of a User.

 

3.3 HOW AND WHEN WILL I RECEIVE MY ORDER?

As we have anticipated before, you can choose to receive the order at your own home or pick it up in store (Barelles Optics)


You have to take into account that, for all this to be possible, it is necessary that you have provided us with the exact information to make the shipment (address, etc.), as well as a telephone number where we can reach you, since we will use it to contact you in case of a problem with the delivery.


Products in stock are received within 24/48 business hours, products available in approximately 7/8 business days and, finally, products in manufacture, we would communicate the approximate delivery time with the possibility for the customer to cancel their order for exceeding delivery times and automatically making the payment of your purchase.

 

3.4 WHAT IF MY ORDER IS FOR SEVERAL ITEMS WITH DIFFERENT AVAILABILITIES?

In this case, the delivery period will be the one that corresponds to the longest duration. In any case, Gafasonline.es may offer you the possibility of breaking down the order to deliver, in the first shipment, the available items and, in later, the unavailable items. Each of these shipments with their corresponding shipping costs, if they exist.

 

4.- GUARANTEES AND TECHNICAL ASSISTANCE

4.1 WHAT CAN I DO IF I RECEIVE THE PRODUCT IN BAD CONDITION?

If when you receive your shipment you notice that the order is not complete or that it has suffered any damage, indicate this when you sign the delivery note of the courier and notify us immediately so that we can contact the carrier.

If the claim is considered justified, we will change the item and send you a new one, in which case, we will bear the transport costs.

All this without forgetting that any other claim could be made at the address indicated in point 1.1.

All products have a two-year warranty for manufacturing defects, meaning a manufacturing defect is a poor finish of the product.

The warranty DOES NOT COVER lenses, scratches, breaks and overexposure to the sun.

 

4.2 RIGHT OF WITHDRAWAL

In relation to the products that we offer on the page, you have to know that, if for any reason you are not satisfied or have received another product by mistake, you have the right to withdraw from the contract for a period of 14 calendar days from the receipt of the good. (You have already received it yourself, or an authorized third party -as long as it is not the carrier-), prior notice by email to the address  pedidos@gafasonline.esor through the form available at the following link: "formulario de desistimiento", although it is not mandatory.

In the event that you have the right and wish to withdraw the purchase, and the order included several of these items and you had received them separately, the period would begin to count from the moment in which the material possession of the last of those goods had been acquired. For the exercise of this right, it is not necessary that you justify your decision, but it will be enough that you communicate it to us unequivocally within that period of 14 days. Shipping costs would be on your account.

Note that any return must be notified to prevail your right of withdrawal of purchase in a timely manner and accepted by gafasonline.es that will give you a return code that will be noted visibly on the outside of the package that you send us (any shipment without code return will not be collected at this company, returning to its origin). Do not forget to attach the purchase receipt or delivery note in your shipment. Once the return is received, the expenses incurred from the shipment will be deducted from the settlement.

To request the return code you must access your account  (https://www.gafasonline.es/create_account.php) select the order you want to return so that the same page generates your return code by sending us your request.

The settlement amount will be paid within a maximum period of 48/72 hours from receipt of the same, after verifying the product and verifying that it is suitable for subsequent sale. The payment will be made in the same form of payment that was chosen when making the purchase. Purchases made by cash on delivery, cash or bank transfer must be accompanied by an account number in order to pay the settlement of your purchase.

Take care when removing and inserting replacement lenses. The warranty policy of our official distributors and gafasonline.es does not cover scratched and / or used lenses and they cannot be returned.

All Custom products, spare parts or lenses will not admit changes or returns and will be processed upon payment. These products will not be able to benefit from the right of withdrawal due to their customization or due to hygiene issues.

If a product other than the one requested by the customer was delivered by mistake by gafasonline.es, it will be withdrawn and the correct product will be delivered without any additional charge to the buyer.

Any incorrect or incomplete shipping address provided by the customer that produces a return and causes expenses, said expenses will be borne by the customer, as the company is not involved in the return.

Gafasonline.es reserves the right to reject returns not communicated or sent after the deadline, or products that are not in the same conditions in which they were received.

4.3 GUARANTEE

Gafasonline.es is responsible for any lack of conformity that appears within a period provided for in consumer regulations and of course, subject to good use of the product. 

(which will be understood to be done on the day that appears on the invoice or purchase receipt, or on the delivery note if it is later).

 

5.- PERSONAL DATA PROTECTION

By virtue of the Personal Data Protection regulations, we inform you that the data you provide us through the page will be incorporated into the files and data processing called "CLIENTS", whose ownership corresponds to  GAFASONLINE, S.L, in order to manage the sale of the selected products, as well as, where appropriate, send you information, including by electronic means, on issues related to the activity of the company and its services.

Your data will be treated with the legitimacy granted by the contractual fulfillment of this commercial relationship, and will be stored for the time established by tax regulations.

We inform you that some of your data will be communicated to the logistics operators so that they can supply you with the products purchased.

You can exercise, at any time, the rights of access, rectification, deletion, limitation of treatment and potability by e-mail addressed to orders@gafasonline.es, attaching a photocopy of the DNI.

 

6.- APPLICABLE LAW AND SUBMISSION TO JURISDICTION

The sale is understood to have been made in Spanish territory, so that for any interpretive or litigious questions that may arise, Spanish legislation will apply and, in the event of a dispute, both parties agree to submit, waiving any other jurisdiction that may correspond, to the jurisdiction of the Courts and Tribunals of the consumer's domicile.
